This Privacy Policy describes the policies of Manifest Audio LLC, 30 North Gould Street, Suite #37849, Sheridan, Wyoming 82801-6317, United States of America (the "Company", "we", "us" or "our"), email: contact [at] manifest [dot] audio, on the collection, use and disclosure of your information that we collect when you use our website ( manifest.audio ) or any of our mobile applications for iPhone and iPad (together, the "Service"). By accessing or using the Service, you are consenting to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.

We may modify this Privacy Policy at any time without any prior notice to you and will post the revised Privacy Policy on the Service. The revised Policy will be effective 180 days from when the revised Policy is posted in the Service and your continued access or use of the Service after such time will constitute your acceptance of the revised Privacy Policy. We therefore recommend that you periodically review this page.

OUR MOBILE APPLICATIONS
This section applies to our mobile applications. Where it differs from any other section of this Privacy Policy, this section governs for our apps.

Our applications collect no personal information. We do not ask for or receive your name, your email address, or any account of any kind, because our applications have no accounts and no sign-in. We operate no server that our applications communicate with.

Our applications contain no analytics, no advertising, no tracking technologies, no cookies and no third-party software development kits of any kind. We do not track you, and we do not link any information from our applications with information from any other source. We do not sell, share or transfer any information from our applications to anyone.

Some of our applications read the sensors on your device, which can include motion, touch, proximity, the microphone, the camera, depth, position and location. Where an application does this, it reads a sensor only while you have switched that sensor on, it converts the reading into a numeric value on your device, and it sends that value only to the destination you have entered yourself, such as a computer on your own local network. Nothing is sent to Manifest Audio LLC or to any third party. Images and audio are analyzed on your device and are never recorded, stored or transmitted by the application.

Where an application can record a session to a file, that file is written to storage on your own device, where you control it. It is not uploaded anywhere.

Where an application offers a purchase, that purchase is handled entirely by Apple through the App Store. We never see your payment details. Apple's handling of that transaction is governed by Apple's own privacy policy, not by this one.

Settings and preferences you choose inside an application are stored on your device only.

Because our applications collect no personal information, there is nothing for us to retain, nothing for us to delete on request, and no consent for you to withdraw. Deleting the application removes everything it has stored on your device. If you would like to ask us about any of this, write to us at contact [at] manifest [dot] audio and we will respond in accordance with applicable law.

OUR DESKTOP SOFTWARE
This section applies to the software we sell for computers: our Ableton Live Extensions, our VST, AU and AAX plug-ins, and our Max for Live devices.

Our desktop software contains no analytics, no advertising and no tracking of any kind. It never reads, records or transmits your audio, your projects or anything about the music you make. We do not build a profile of you, and we do not sell or share information about you with anyone.

Licensing. Our paid Extensions and plug-ins are unlocked with a license key, which is checked against Lemon Squeezy, our e-commerce provider. When you activate a license, the software sends your license key and a label identifying that installation to Lemon Squeezy. In our plug-ins that label is your computer's name as your operating system reports it, which on some computers contains a personal name. Lemon Squeezy returns an identifier for the installation, which is stored on your own computer. On later launches the software sends only that identifier, so that the license can be confirmed as still valid, and it continues to work offline for up to seven days between checks. If you deactivate an installation, the identifier is sent once more so that the activation can be freed for use on another computer. You can ask us to delete your license records at any time by writing to us at contact [at] manifest [dot] audio.

Update checks. Some of our desktop software, including our Ableton Live Extensions, checks whether a newer version is available by requesting the relevant product page on manifest.audio when it starts. That request reaches our website in the same way an ordinary browser visit does, which means our website provider records your IP address in its logs. The request carries no license key and no identifier, and we do not use it to count or to identify anyone.

Our Max for Live devices are delivered to you as files and contain no license check.

HOW WE USE YOUR INFORMATION
We will use the information that we collect about you through our website for the following purposes:

  • Ensuring continued service

RETENTION OF YOUR INFORMATION
Our mobile applications collect no personal information, so there is none to retain. Deleting an application removes everything it has stored on your device.

For information collected through our website, we will retain your personal information with us for 90 days to 2 years after users terminate their accounts or for as long as we need it to fulfill the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods such as record-keeping / reporting in accordance with applicable law or for other legitimate reasons like enforcement of legal rights, fraud prevention, etc. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely.

YOUR RIGHTS
Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. Do note that if you do not allow us to collect or process the required personal information or withdraw the consent to process the same for the required purposes, you may not be able to access or use the services for which your information was sought.

SECURITY
The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

THIRD PARTY LINKS & USE OF YOUR INFORMATION

Our Service may contain links to other websites that are not operated by us. This Privacy Policy does not address the privacy policy and other practices of any third parties, including any third party operating any website or service that may be accessible via a link on the Service. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Where we share your personal information with any third party, we require that third party to provide the same or equal protection of your personal information as is stated in this Privacy Policy.

This section applies to our website, our customer communications and the licensing of our desktop software. Our mobile applications use no service providers of any kind and share no information with anyone.

We rely on the following providers, each of which processes personal information on our behalf and under our instructions:

Lemon Squeezy, our main e-commerce and checkout provider, which processes your name, email address, billing address and order details in order to sell our products to you, to deliver files to you, and to handle tax compliance. Lemon Squeezy also issues and checks the license keys for our desktop software, as described in OUR DESKTOP SOFTWARE above.
Gumroad, a secondary e-commerce and checkout provider used for a small number of our products, which processes the same categories of information for the same purposes.
SendGrid, our email delivery provider, which processes your name and email address in order to send you the newsletters, order messages and product updates you have asked for.
Dinamo Foundry, whose servers host the font files this website uses, and which may therefore receive information about your browser, network or device and your IP address when a page loads.

We require each of these providers to give your personal information the same or equal protection as is stated in this Privacy Policy. We do not sell your personal information to any of them or to anyone else.

Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information. In order to comply with Fair Information Practices, should a data breach occur, we will notify our users via e-mail within 30 days of becoming aware of such breach.

CALIFORNIA ONLINE PRIVACY PROTECTION ACT (CalOPPA)
